Do I have to appear in Court?

Yes. Usually between 20 and 40 days after you file your petition, the trustee will hold the "first meeting of creditors" (also called a "341" meeting). THE DEBTOR’S APPEARANCE AT THE MEETING IS MANDATORY. The trustee can ask you questions under oath about your property and debts.

Generally, the only responsibilities you have with respect to the bankruptcy after the 341 meeting is to cooperate with the trustee in providing any requested information.

Necessary Documentation

Please provide as much of the following documentation as possible to prepare for your initial consultation.

  • Copies of your Tax Returns/W-2’s for the last two years you have filed.
  • Paystubs/Income Verification for the past 6 months.
  • Copies of all updated mortgage statements and  a copy of your deed (if available)
  • Copies of most recent credit card statements/personal loans, as well as communication received from any collection agencies.
  • All information regarding any active lawsuits (debt collection, foreclosure, etc.), judgments, orders or wage garnishments.
  • Most recent utility bills.
  • Copies of statements of all current bank accounts.
  • Copies of statements for any 401K/retirement accounts and student loans.
  • Copy of an updated car statement (both lease and financing).
